Our Company

LawTalk MCLE, Inc. incorporated in California on February 14, 1992.  Our objective is to provide high quality Minimum Continuing Legal Education (MCLE) to legal professionals around the world.  Our current delivery channels include:

Our programs and marketing efforts are based upon helping attorneys meet their Minimum Continuing Legal Education (MCLE) hours while (1) learning skills they need to actively compete in the global marketplace; and (2) having a pleasant experience that is considerate of their schedules and budgets.

Our Marketplace

Currently (in the United States) 40 states have Minimum Continuing Legal Education requirements as a condition of maintaining a license to practice law.  These states include approximately 1,000,000 lawyers.  Each lawyer is required to complete from 10-15 hours of MCLE per year.  Most states require all hours to be in the traditional seminar setting, although some states allow some or all of the requirements to be satisfied by self-study audio, video and interactive programming.

The North American market for MCLE programs and products is estimated to be over $2 billion annually.  Additionally, there is a growing global MCLE marketplace, especially in the United Kingdom, Canada and Australia/New Zealand.  We believe that our customer service, skills-oriented approach can gain significant market share profitably in what has been a traditional content-directed school model.

All our programs are skills-oriented and usable by any lawyer in the English speaking world.[2]   This approach allows us to avoid the state-by-state limitations of most traditional continuing legal education.  We have presented our programs in England, Ireland, South Africa, Australia, New Zealand, Canada, and throughout the USA.

Our Competition

Competitors in this market include Practicing Law Institute, The National Law Journal seminar division, The Rutter Group and numerous state and local bar associations.  While there are a few national providers of substantive law MCLE, most MCLE is delivered through state, local and regional bar associations emphasizing substantive law updates.

LawTalk™ focuses on skills-oriented programming, which allows us the competitive advantage of offering our products to a universal audience of lawyers.  Legal practice continues to become more specialized in subject matter area, so that substantive law programs are useful to lawyers who regularly handle matters in that particular area.

Our skills-oriented programming is of general application, regardless of the particular substantive area that may dominate each individual lawyer’s practice.

Our Strategy

We compete on the basis of superior quality programming, aggressive marketing, and intense attention to the convenience and comfort of practicing lawyers.

Our strategy is (1) to use multiple marketing media to attract lawyers to choose LawTalk™ for all or a portion of their MCLE requirements; (2) to make their experience with us so useful, convenient, and pleasant that they will use LawTalk™ for their future MCLE needs; and (3) to encourage our attendees to recommend us to their colleagues.

Because of the seasonal characteristics of the MCLE marketplace, our sales strategy includes heavy promotional efforts for our MCLE seminars from September through January.  During the remaining months we focus on in-house presentations, June deadline states (approximately 300,000, out of the entire marketplace of 1,000,000), year-round compliance states (Texas and Florida) and various state and local legal conventions.

We mail and insert high quality full color brochures.  We broadcast fax and broadcast email to relevant market segments.  We use proactive telemarketing to contact large firms and individual lawyers who are faced with compliance in 30-90 days.  In our marketing materials and at our seminars we solicit in-house business with law firms, and corporations whose representatives have chosen to attend our programs.

Our advertising promotion and sales strategies are intended to position LawTalk™ as the global leader in skills-oriented continuing legal education.

Our Intellectual Property

We have filed service marked protection for LawTalk™ MCLE, Inc., Negotiate like the Pros™, and MouthPiece Magazine™, LawTalk-LA.  We have copyrighted all of our books, tapes, and manuals.  We intend to be vigilant in detecting infringement and taking action to protect these service marks, our copyrights, our trade secrets, and any and all other intellectual property.

Projects in Development

Landmark Education - We believe a 3-hour module to be presented as part of our LawTalk™ Powerful Profession Skills Seminars and Negotiate like the Pros™ programs can be developed.  Royalty income would thereby be generated for Landmark.  We also believe we can enroll a portion of our overall attendance into the entire Landmark curriculum wherein LawTalk™ would provide the administrative support for CLE credit.  Further, we can "qualify" Landmark Education programs for CLE credit in various jurisdictions.

Mission Control - We believe we can join Mission Control to assist in developing a vertical market in the legal profession.  A 3-hour module in our Powerful Profession Skills Seminars and Negotiate like the Pros™ programs will enhance our LawTalk™ offerings and generate royalty income to Mission Control.  Royalty income will also be generated from a fully developed one-day Mission Control program dedicated specifically to legal professionals.  Additionally, we would be pleased to assist in the development of program materials, promotional pieces, and presentation skills coaching for Mission Control program facilitators.

MouthPiece Magazine™ - We believe there is a significant opportunity to launch a lifestyle magazine designed specifically for legal professionals.  Not only would this publication be a profit center on its own, it would provide substantial opportunities to dramatically expand our LawTalk™ / Negotiate like the Pros™ space advertising efforts.

Our game plan is to initially develop a web site that would be the graphic and editorial content of MouthPiece Magazine™ published on the web bi-monthly.  This graphic and editorial content would also be the basis for our CD direct mail promotion for our seminar offerings.

The hard copy publication of MouthPiece Magazine™ would eventually be realized through a strategic alliance with an existing experienced publisher.

LawTalk LA™ Radio and Television - We are in initial meetings with television producer, Nicki Nicastro McQuistion, in the development of radio and television programming about the legal profession in a weekly review format.  This programming would allow us to raise our profile in the marketplace.

John Patrick Dolan as LawTalk's™ CEO and spokesperson is now appearing regularly as a legal affairs expert commentator on Court TV, MSNBC, Fox News Channel, and The Burt and Kurt Center for Common Sense on The Source Radio 101.1 FM in Birmingham, AL.  It is our intention to use this radio and television exposure to maximize attendance at LawTalk™ MCLE programs.

LawTalk Consulting – We are currently gathering resources and personnel to offer business management, litigation, and financial consulting services to small and medium size law offices.

E-Magazine - LawTalk™ MCLE and Negotiate like the Pros™ monthly e-magazine offerings are in development at the Gitomer Group.  The intent of the monthly e-magazine is to provide a skills tip, lawyer joke, and a web link to our respective marketplaces.  This approach allows for additional low cost branding.

CD Promotional Program - As indicated in our 5-year financial model, we intend to dramatically increase our direct mail advertising efforts.  We intend to produce a CD that offers free CLE in return for the user reviewing a product promotion.

The CD would contain a series of promotional pieces for LawTalk™ / Negotiate like the Pros™ seminars as well as advertising promotions for products relevant to the legal profession, i.e., office supplies, luxury automobiles, clothing accessories, etc.

Each one-minute product video review would entitle the user to one-hour of free CLE on-line.

The advertising revenue opportunities are dramatic.

In addition to the CD, the direct mail package would contain hard copy advertisements for LawTalk™ / Negotiate like the Pros™ seminars and products.

GenderSense™: How Successful Men and Women Negotiate™ / WorldClass Negotiation™/ The Art of Trial/ Ladies and Gentlemen of the Jury/ Tongue Fu… The Way of the Mouth Warrior Book Projects - All these books are presently in the final editorial review. LawTalk™ Publications will make these books available for distribution with a major publisher and in the alternative self-publication for general distribution and our seminars.  The printing of these books is projected to commence in January 2005 and be complete by June 2005 subject to publisher's schedules. 

GenderSense™: How Successful Men and Women Negotiate™ / WorldClass Negotiation™/ The Art of Trial/ Ladies and Gentlemen of the Jury/ Tongue Fu… The Way of the Mouth Warrior Book Projects - Our editorial consultants at Creative Services are developing the scripts for the companion audio products for both new books.  Development time is projected at 90-days, as the editorial content of the already completed books is the basis for the scripts.

Our Advisory Group

We have developed a number of trusted advisors who assist us on an out-sourced basis with the various projects we have in development. 

Dale Irvin - Editorial Coordinator for MouthPiece Magazine™, LawTalk Publications™, and our e-zine efforts.  Dale owns 1,000,000 shares of LawTalk™ stock.  He is an author and publisher and is also one of our presenters in our Powerful Professional Skills Seminars.

Joseph Calloway - Program Development Advisor.  Joe assists LawTalk™ in developing programs taken from the general business marketplace and tailored to the legal marketplace.  Joe owns 200,000 shares of LawTalk™ stock.

Robert Sherman, Esq. - Presentation Skills Program Developer and Presenter.  Rob has an active law practice in Columbus, Ohio and is an author and professional speaker.  Rob owns 200,000 shares of LawTalk™ stock.

Janita Cooper - Audio Product Coordinator.  Janita is President of Master Duplicating Corp. which handles all our audio recording and tapes/CD development and production.  Janita owns 100,000 shares of LawTalk™ stock.

Larry Winget - Product Development Advisor.  Larry is a master at designing, producing and marketing books, audios, t-shirts and various other products.  He is an author, professional speaker, and astute business professional.  Larry owns 2500 shares of LawTalk™ stock.

Graham Davies - UK Business Development Advisor.  Graham is a British Barrister who is also a professional speaker.  He has assisted us in learning about how we might break into the UK marketplace.  Graham owns 1500 shares of LawTalk™ stock.

Nido Qubein - Business Advisor.  Nido's company Creative Services has assisted us in the capacity of an editorial advisor on publications and a confidential business advisor on assessing our marketplace and our company expansion.

Jeffrey Gitomer - Jeff's company is assisting us in developing two e-magazine products, one for a LawTalk™ MCLE and one for Negotiate like the Pros™.

Gary Serota - Direct Mail Advertising Advisor.  Gary's company assists LawTalk™ / Negotiate like the Pros™ in writing direct mail copy and designing direct mail packages.

 

[1] LawTalk™ has produced and contracted to produce numerous video and self-study programs.  Many states will allow lawyers to obtain some or all of their required CLE hours by using such products.

[2] We are looking to expand to languages such as Spanish, French, German & Japanese.
